1 - FOREWARNING

All those who place an order through the website declare being aware of these selling terms and conditions and accepting all of them. CRÉA'PAYSAGE proposes a choice of plants as part of online selling. The relationships between the company and the buyers are established with complete independency. The nursery has the right to modify these selling terms and conditions at any moment.

2 - PRICE

The prices appearing on this website are all taxes included (T.T.C.) and in euros (€), post and package not included. It is possible to invoice the items excl. tax for the companies from the CEE (beyond France) having an E.U. intracommunal VAT number. The total price indicated in the confirmation of order by CRÉA'PAYSAGE is the final price comprising the price of the ordered items, the handling, packaging and transport charges.

3 - PAYMENT

Payment is carried out when placing the order, either by credit card online under secure payment or by transfer payment to our account (IBAN), and even by bank or post office check (only in France). You can also place an order by printing and sending the order form online to the following address (§ 9). The orders will only be approved after reception of the payment.

4 - VALIDITY OF PAYMENT

The last « click » allows you to validate the order. It is the equivalent to the hand signature designed in the article 1341 of the French civil code. Thus, by sending the order form by e-mail, you entitle CRÉA'PAYSAGE to debit the total amount of your order from your payment card. The order will be validated after authorisation of the transaction by the buyer’s bank.

5 - POSTAGE AND PACKAGING

Postage and packaging charges are automatically calculated and indicated online on the order form.

6 - DELIVERY

Except by any cultivation incidents, the plants appearing online belonging to CRÉA'PAYSAGE are almost always available The maximum delivery time generally established is 15 working days for Mainland France from the date of the order validation The articles are carried under the responsibility of the beneficiary who is the only one to verify the conditions of the articles in the package and has the right to enter specific reservations of use in the presence of the carrier. The items will be delivered to the address indicated by the customer. When receiving the payment, CRÉA'PAYSAGE accepts the order and proceeds to delivery. The information provided when placing the order is under the responsibility of the buyer: in case of any errors in the addressee’s contact details, the seller will not be held responsible for the impossibility to deliver the articles. Any return due to an error in the address or to the impossibility of delivery non attributable to CRÉA'PAYSAGE will be invoiced. The orders are deliverable at one time to the same place.

7 - JURISDICTION

These selling terms and conditions are subject to the implementation of the French laws. The contractual information are presented in French. The stranger buyers should verify the legislation in force to which they are subject for the import of plants and other items. CRÉA'PAYSAGE is not to be held responsible for the breaking of the laws of the country where the items are delivered. It is recommended to contact the company first in the case of litigation in order to solve it by amicable agreement. Otherwise, only the Court with jurisdiction over our nursery will be in charge of handling the litigation.

8 - DATA PROTECTION

CIn accordance with the article 27 of the data protection act (n°78-17, 6th January 1978), CRÉA'PAYSAGE customers have the right to access and modify their personal data by anyone of the proposed methods (see § 9). All the data collected by CRÉA'PAYSAGE are totally necessary for a correct treatment of the orders or the availability of individualised services.
As the tree nursery is a member of the association "Plantes-Web", contacts and customers will also receive the newsletter of the association Plantes-Web.
